SUBJECT
- The company offers products in the form of access to electronic versions of design documentation (projects), development of individual projects, and other services as described on the website. The execution of certain orders may require the conclusion of an additional contract if it is indicated on the product description page.The company undertakes to fulfill the order placed on the website on the terms of this offer and taking into account the essential conditions indicated on the product description page. If the conditions of a specific product differ from the general terms of the offer, the conditions of the specific product shall apply.Placing an order signifies the unconditional and irrevocable acceptance (acceptance) of the offer, the company's policy, and the terms applicable to the specific product.
- The company undertakes to fulfill orders provided that:
- the website contains information about the price and availability of the product;
- the functionality for placing an order through the website interface is active;
- the full cost of the order has been paid;
- no restrictive measures have been applied to the customer that would prevent the order from being fulfilled;
- no other obstacles to the execution of the order are discovered during its processing.
ORDER PROCESSING AND PAYMENT
- The client shall independently process orders using the website interface or by contacting a Company representative in person.The cost of each product is indicated on the product description page. The order cost may also include delivery charges, if the Company can determine the cost of shipping prior to dispatch. All payments shall be made in the national currency of Ukraine - hryvnia. In the case that the client is a Ukrainian citizen residing outside of Ukraine, a foreigner, stateless person, or foreign legal entity, all payments shall be made in a currency available for selection on the payment page.
- The client has the right to make payment for the order using one of the following methods:
- via bank transfer;
- using a specific payment identifier;
- on the website using the selected payment system.
- Payment is considered to be made after the funds are credited to the Company's account or after receiving the appropriate confirmation of payment and debiting of the customer's account from the financial intermediary. When making a payment using certain payment methods, additional fees or other charges may be levied as provided by the rules of the financial intermediary. In the event of the Company's refusal to fulfill the order, the refund of funds is made in accordance with the Rules of Returns.
ORDER EXECUTION PROCEDURE
- Access to electronic versions of design documentation is provided within 24 hours from the moment of receiving payment by sending the client a file with an electronic version of the project or a link to the page where the specified file can be downloaded. Order fulfillment deadlines may be specified on the product page or agreed with the client separately. The provision of services is carried out by taking certain actions described on the product page. The Company may suspend or refuse to fulfill an order if additional information is required from the client for the proper fulfillment of the order and the client does not provide or respond to the Company's requests. The Company is not responsible for the final implementation of the project and any damage caused to the client or third parties as a result of such implementation.
COPYRIGHT
- All exclusive property rights of intellectual property for projects belong to the Company and the authors of the projects, both before and after their acquisition by the client. After payment, the client has the right to use each purchased project only once (single project implementation). To implement the solutions contained in the project again, it is necessary to purchase a new project. Transferring the electronic version of the project file or a link to the file to other persons is allowed only if it is done for the implementation of the project.
OTHER TERMS
- The resolution of any conflicts and disputes between the Company and the client depends on the residency of the client and the Company. In case the client is a resident of Ukraine, all conflicts and disputes shall be resolved by national courts of Ukraine in accordance with national legislation of Ukraine. In case the client is not a resident of Ukraine, the future contractual relations between the client and the Company shall be governed by the law of Ukraine. The client agrees that the application of Ukrainian law does not limit the protection of consumer rights, which are provided to him by mandatory provisions of the law of the state where he resides, stays or is located.
AMENDMENT OF TERMS OF OFFER
- The Company reserves the right to amend this Offer at any time and in any way by notifying the customer of such changes by posting a new version of the Offer or specific amendments on this website. Changes take effect from the moment of their publication on the website, unless otherwise specified at the time of their publication.
